Trading Technologies Statement Regarding Erroneous eSpeed News Release

 

CHICAGO, January 14, 2008 — eSpeed’s January 10, 2008 press release titled "Court Reverses Jury Decision in eSpeed-Trading Technologies Patent Case" is not accurate. eSpeed said, "In his January 3, 2008 order, the judge agreed with eSpeed's motion for a judgment as a matter of law, overturning the jury's October 10, 2007 verdict that certain versions of eSpeed's futures-trading software had infringed TT's patents."

This is not true. The Court, on the same day in a separate decision, denied eSpeed’s motion to set aside the jury’s verdict of infringement. This order is posted at: http://www.tradingtechnologies.com/news/011408_eSpeedCase-file.pdf.

The Court order referred to by eSpeed merely overruled the jury's finding of willfulness, which is only relevant to the issue of whether the jury's $3.5 million transaction-based damage award for just 4-5 months of infringement should be increased. The jury's finding that eSpeed is liable for patent infringement stands.
